A Valencia County woman was taken to University of New Mexico hospital following serious injuries she suffered when involved in an accident with a construction vehicle. According to reports, the woman rear-ended the large truck on Highway 47. However, uncommon for such New Mexico car accidents, reports suggest that the woman is not responsible for the accident. Instead, police have indicated that the truck driver will be cited for failure to yield and improper equipment.
If officers conclude that the negligent driving or operation of the commercial vehicle was a cause of the car accident, then there may be a possible New Mexico truck accident claim against the driver’s employer and their insurance carrier. Such claims can be based entirely on the failure to properly load, secure, and warn when a commercial driver is involved in an accident.
