Police are reporting a fatal Albuquerque accident that occurred on 1/12. According to police, the accident occurred when a sedan ran a stop sign entering an intersection in front of an approaching dump truck. The truck hit the right side of the car resulting in the sedan passenger’s death. The Albuquerque accident raises a couple legal issues, one of which is when can a passenger, or his or her family recovery from the driver. Generally speaking, the answer is that a passenger in an Albuquerque accident can recover from the driver of the vehicle he or she was in if the driver was negligent or somehow contributed to the accident. Another issue raised in the case is that although the driver running a red light contributes to the collision, in the event that the dump truck driver had an opportunity to avoid the impact but did not act properly, there may be comparative fault allowing for an additional recovery.
